These General Terms and Conditions apply to all contracts between EMATHON, owner Nikolaos Papadopoulos, Bachstrasse 7, 73061 Ebersbach an der Fils (hereinafter referred to as "Provider") and its customers regarding the provision of services in the areas of e-learning creation and consulting as well as installation of monitoring and smart home systems.
The supplier's offers are non-binding. A contract is concluded either through written order confirmation from the supplier or through the commencement of service provision.
The specific scope of services is defined in the respective offer or order confirmation. For installation services: The service area covers a radius of approximately 20 km around 73061 Ebersbach an der Fils; any service areas outside this radius require a separate agreement.
The customer shall provide all information, access, and documentation necessary for the performance of the services in a timely manner. For installations, the customer shall ensure accessibility to the installation sites and a functioning power and internet supply.
The prices quoted in the offer apply, plus statutory VAT. Invoices are payable within 14 days without deduction.
The provider assists the customer with the GDPR-compliant positioning and configuration of the systems. The customer is responsible under the GDPR for the ongoing operation of the installed systems.
The statutory warranty rights apply. The provider is liable without limitation in cases of intent and gross negligence, as well as in cases of injury to life, body, or health. In cases of simple negligence, the provider is only liable for breaches of essential contractual obligations, limited to foreseeable damages typical for this type of contract.
The provider grants the customer the usage rights agreed upon in the offer for the created e-learning content. All rights remain with the provider until full payment is received.
The laws of the Federal Republic of Germany apply. The place of jurisdiction is – to the extent legally permissible – the registered office of the provider. Should individual provisions be invalid, the validity of the remaining provisions shall remain unaffected.
